Eviction Action Orange County CA : Can a private investigator help with an eviction ?

Yes, the most important action a private investigator can provide after an eviction is undisputed documentation of the condition of the property and if the tenant has left behind any belongings, furniture, clothing or equipment.  A private investigator is licensed and bound by state and federal laws, he understands the legal and justice system rules and evidence procedures. Courts, law enforcement and attorneys respect and recognize private investigators because they know that we get paid for our time and we only report the facts and supporting evidence.  There is no benefit or a logical reason for a private investigator to lie or fabricate a story since we are compensated based on our time and efforts and NOT results.

The landlord is vulnerable for civil suits filed by the tenant’s attorney since a forged claim can be fabricated to indicate valuable belongings and property was left behind.  Remember that as the landlord you have kicked out a tenant who doesn’t pay rent and a trouble maker who will try to retaliate.  Most lawyers and attorneys will take their case on a contingency since they know that the landlord owns a property which the best asset to file a lien for a judgment.  A private investigator can video tape and photograph the property and write a precise report signed under oath that provides the truth and will contradict the defendants and tenants forged claims and accusations.  In return any lawyer or attorney will have no choice but to dismiss the lawsuit or any legal action since an officer of the court has a duty to present the truth and can’t be involved with a fraudulent and fabricated case at any cost.

According to California a landlord is not allowed or permitted to physically evict the defendant or a tenant; even if the court has entered a judgment in the favor of the landlord.  This includes the removal of or interference with the tenant’s belongings. The Sheriff must carry out the court’s order of removing the tenant by giving a 5 days notice.  The Sheriff  will only remove the tenants or any persons and NOT their possessions. All possessions and belongings will stay in the residence and will remain in the home.
