The priest-penitent privilege, or the clergy privilege, refers to the right to protect the contents of communications made between a member of the clergy and an individual who shares information with the intent not to be disclosed. The rules of the priest-penitent privilege are not as well defined  as the other privilege rules. For example, in twenty-five states the priest-penitent privilege does not clearly state the holder; in seventeen states the penitent is stated  as the holder of the  privilege; in six states both a penitent and a priest are stated as the holders. The priest-penitent privilege may not cover communications in divorce, criminal, and ministerial misconduct cases. The privilege may also be waived in cases when the member of the clergy is a trained psychologist or secularly licensed counselor required by state law to report child abuse.
