My client has a judgment against an individual who is an artist. I have located the studio of the artist and its full of art work. This is a well known artist and the art work is selling for lots of dough1
Since I have a judgment for over 26K, I’m thinking that I can “seize” the painting as partial payment for the debt.
I don’t mean that I plan to place a “keeper” in the studio, since selling art is not a steady flow of cash.
The artist has painting in different art studio’s in different locations.
I would like to seize these also.
Have not done this in a very long time so I’m not up to date on whether I can or not or should even attempt this.
Any thoughts on this.
You can get file a Motion to get a court order to seize paintings at the
artist’s studio or residence, but you have to be very specific in
describing the painting(s) you want taken, or most Sheriffs won’t do it.
Around here, it is called a Seizure Order. Call your local Sheriff and
see if they do “Seizures of Personal Property”. They’ll probably charge
you a couple hundred bucks, and they’ll want very specific instructions
about the paintings, and where they are located on site.
Some courts also expect you to get a Writ in the amount of the judgment
before they’ll issue the Seizure Order. You’ll need the Writ issued for
the county where the artist/debtor has their studio and paintings.

If you mean artist has paintings for sale in different _galleries_ in
different locations, you can file a Motion for the court to issue an
Assignment Order to the gallery owner, and if one of the debtor’s
paintings sell, the owner is supposed to turn over X% of the proceeds to
you instead of the debtor. You can usually get the court to order 25% of
each sale goes to your judgment creditor. The Motion also has to name
specific galleries and owner’s names to be valid.
Most attorneys don’t deal with this type of Motion, so you and the
judgment creditor may be on your own. Give me a call if you want
