It is usually not recommended to rehearse a witness’s trial testimony as the witness’s answers may appear to be coached. However, the subject matter of the examination should be discussed prior to the examination. The witness’s depositions should have been provided to the witness, and any statement that might surface during cross-examination should be discussed. any interrogatory or other pleading should be discussed with the witness along with any medical record or other document that might be used for cross-examination. If there is evidence that the witness does not want to present because its presentation before the Court and jury might be embarrassing, this evidence should be evaluated. another effective method to prepare the witness for the trial cross-examination during the deposition is to allow the opposing counsel to attack the witness so that the opposing counsel to attack the witness so that the opposing counsel covers all weak spots at the deposition.
Preparation of different witness types
It is important to tailor witness preparation to meet different types. The profile of the witness is as significant as the facts that witness may respond to. Therefore, the witness’s profile must be evaluated prior to depositions and trials. As a result of this evaluation, the investigator must prepare the witness to control his/her own emotions in order to make a good impression on the jury. The following are the most common types of witnesses:
– The “know-it-all” type – believes that only his/her story is worth listening to
– The “know-nothing” type – knows only a few facts
– The “scared” type – intimidated by litigation process
– The “chatterbox” – volunteers information
– The minor type – children who feel uncomfortable and intimidated
– The expert type – a witness who possesses professional knowledge of the subject matter.
