Driver’s license in California and illegal immigrants before the entry into force of AB 60
To date, illegal immigrants can not get a driver’s license in California. Many people need to get to work by car, and they sit behind the wheel without a license. When they were stopped by the police, they indict under California Vehicle Code 12500 (do not drive a car without a license). In California, a violation under 12,500 may qualify as a minor offense (infraction), or as a criminal offense (misdemeanor). If the offender indict for a minor offense under Article 12500, it can challenge the charge transport in court or pay the fine and not afraid of any immigration consequences.
On the other hand, when indict for criminal offense under 12,500, the offender must appear before the Criminal Court. Many illegal immigrants are unreasonably afraid of being arrested in a criminal court and deported, so many decide not to come to the hearing. Failure to appear in court complicates matters even more. If an illegal immigrant living in one of the districts in California, which is cooperating with the federal government on the program of community safety, more likely, that his arrest and the deportation process will begin after the immigrant fails to appear in court or found guilty of a criminal offense punishable under Article 12500.
If the governor will sign the bill AV60, illegal immigrantam no longer have to fear deportation after they are stopped by police for minor traffic violations. Illegal immigrants will be able to insure and REGISTER cars, showing a driver’s license obtained by AV60. Moreover, AV60 prohibits discrimination against people who place a driver’s license obtained under the law AV60. As a result, illegal immigrants who have violated the rules of the road, will be treated the same as any driver who has a valid driver’s license -not will try to determine their immigration status.
In addition, illegal immigrants with open cases under 12,500 will be able to ask for a delay in order to obtain a driving license. After receiving a driver’s license, they will be able to ensure that their case was closed, and thus avoid a criminal record.
Illegal immigrants can not get a driver’s license as long as this bill does not sign the governor of California, and while the Office of Motor Vehicles (DMV) will not lead it into action.
